Terms of Service

Last updated 15 October 2026

This is a working draft pending legal review. The operator's company details will be added before KiteWP accepts payments.

1. The service

KiteWP creates custom WordPress themes from the information you give us in our online wizard, using artificial intelligence reviewed by automated checks. We can also provide a domain name and hosting so that you receive a ready-to-use website. Generated themes are designed to be production-ready, but as with any software you should review your site before publishing it.

2. Your account

You need an account with a verified email address to submit a theme request. Keep your password safe; you are responsible for activity in your account. We may suspend accounts that break these terms.

3. Free theme build

Your first theme demo is built for free and can be previewed online. Downloading the theme requires a purchase. You can have one free demo that you have not bought at a time: to start a new free demo, first buy the previous one. Demos that were not bought, including those that went to the archive, keep counting until they are bought. Change requests are available once the theme is bought. A bought theme includes 1 change request in total. More can be bought in packs (3 change requests for $5.00).

4. Themes you do not buy: the KiteWP archive

When your theme is ready you can look at its private live demo and request changes. You then have a decision period (shown on your theme page and in the wizard, currently 1 day) to buy it. We remind you by email 7, 3 and 1 days before it ends.

If you do not buy the theme within the decision period, it is published in the public KiteWP theme archive as it is, with the content and images it contains (texts, logo, photos, contact details), and offered to other customers and subscribers. You agree to this with a separate checkbox when you order. If you do not want your theme or content to be published, buy the theme within the decision period. If you later ask us to change personal details in an archived theme, write to support.

5. Themes you buy are yours

A custom theme you buy is exclusive to you: we never sell it to anyone else, never add it to the archive and never offer it again.

6. Licence

After payment, a custom theme is fully yours. You may use it, its companion plugin and its demo content on any number of websites, change it in any way, and sell, resell or give it to others, alone or as part of your own products, with or without your changes. Images, logos and texts that you provided remain yours. Fonts and other open-source parts included in the theme keep their own open licences (included in the theme), which allow all of this.

Themes from the archive, bought on their own or downloaded with a subscription, are not exclusive: other customers can get the same design. You may use them on any number of websites and change them freely, but not sell or distribute the archive theme itself as a theme product.

7. Your content

You confirm that you have the rights to everything you upload or enter (logos, photos, texts, trademarks) and that it is lawful; you are responsible for material that belongs to someone else. You give us the permission needed to use it to build, preview and deliver your theme, and, if you do not buy the theme, to publish it in the archive as described in section 4.

8. Prices and payment

Prices are in US dollars and are shown in the wizard before you submit and on every invoice. Checkout accepts cryptocurrency (USDT, USDC, TRX and LTC on the networks listed at checkout); see how to pay with crypto. Other payment methods can be arranged on request through a support ticket; their terms are given to you before you pay. With crypto, you send the exact amount shown to the address shown, on the network shown, and enter the transaction hash. Coins sent on another network or to another address cannot be recovered by us.

Every confirmed transfer is credited to your account balance at its US dollar value (TRX and LTC at the rate locked for 30 minutes when you chose the coin), and the balance pays your invoice. If less arrives than the invoice asks for, the difference remains due; anything above it stays on your balance for future purchases. Crypto transfers cannot be reversed. Refunds are given only where a product is defective and we cannot fix it, as account balance or in the coin you paid with. Digital products are delivered immediately after payment; where the law allows, you agree that the right of withdrawal ends once the download starts.

9. Subscriptions

Archive subscriptions give access to archived themes for the period and within the download limits shown when you subscribe. They are paid in advance. Before a period ends we send a renewal invoice; if you turned on automatic renewal, it is paid from your account balance when the balance covers it.

10. Domains and hosting

Domain registrations are subject to the rules of the registry and registrar, including ICANN policies. Hosting is subject to our acceptable use rules: no illegal content, malware, spam or abuse of shared resources. Services not renewed on time may be suspended and later removed.

11. Trademarks

WordPress, WooCommerce and Elementor are trademarks of their respective owners. KiteWP is an independent service and is not affiliated with or endorsed by them.

12. Liability

We build every theme with care, but we cannot guarantee that it fits every purpose or works with every third-party plugin. To the extent permitted by law, our liability is limited to the amount you paid for the affected service. Nothing in these terms limits rights you have as a consumer under the law of your country.

13. Changes and contact

We may update these terms; the version shown when you submit a request applies to that request. Questions? Contact support. See also our Privacy Policy.
